Upload Agreement

This Upload Agreement (version 2026-11-01) is between you and VibeDojo — operated with Cardinal (“Kryptonite”, “we”) and supplements the Terms of Service. It applies to every sound and every piece of metadata (title, description, tags, attribution) you submit. You accept it by ticking all the statements in the upload form; uploads are not possible without accepting it. If you upload on behalf of someone else (e.g. a client or employer), you confirm you are authorised to bind them.

For each upload, you confirm all of the following:

1. I own all rights to this sound, or hold a licence that permits its publication and redistribution.
2. The file contains no third-party copyrighted material (music, film/TV/game audio, other creators' clips) unless I hold a licence for it.
3. It contains no recordings of people without their consent and no hateful or illegal content.
4. The file is not malicious and I have not tampered with it to carry anything other than audio.
5. I grant Kryptonite a worldwide, non-exclusive licence to host and distribute this sound to users and AI agents under the licence I chose.
6. I am solely responsible for this upload and will indemnify Kryptonite, VibeDojo and Cardinal against any claim arising from it.
7. I accept the Terms of Service and the Upload Agreement.

You represent and warrant that, for every upload:

• Rights. You are the author and sole owner of all rights in the sound (including copyright and related rights in the recording), or you hold a written licence that allows you to publish and sublicense it on the terms below.
• No third-party material. The sound does not contain — even partially, slowed, pitched or remixed — music, film, TV, game, streaming, podcast or other audio owned by others, unless your licence expressly covers it.
• People. Any identifiable person whose voice is recorded has given consent to the recording and to its public distribution; the sound is not an AI-cloned or synthetic imitation of a real person's voice.
• Lawful content. The sound and its metadata comply with the Acceptable Use Policy and the law, and do not contain personal data of others.
• Clean file. The file contains only audio. It is not malicious, has not been tampered with to carry other data, and you have not tried to evade our checks.
• Accurate metadata. The title, tags, attribution and chosen licence are truthful and not misleading.

You keep ownership of your sound. You grant Kryptonite a worldwide, non-exclusive, royalty-free, sublicensable licence, for as long as the sound is published and for a reasonable period afterwards for backups and legal records, to:

• host, store, copy, re-encode, normalise, analyse (e.g. duration and waveform) and scan the sound;
• display, stream and distribute it to users of the website and to AI agents and software through the MCP server, the REST API and the Studio;
• use its title, metadata, waveform and short previews to present and promote the Service, including in search results and social cards.

Our sublicensable right is limited to our service providers (e.g. hosting and CDN) and to users and agents, who receive the sound under the licence you chose. Copies already downloaded before you delete a sound may continue to be used under that licence.

Files must be audio (MP3, WAV, OGG, M4A, AAC, FLAC, WebM or Opus), at most 4 MB and 30 seconds. We verify the file type from its content, fully re-encode it to MP3 (which removes metadata and any embedded payload), compute a checksum to prevent duplicates and may check its hash against malware databases. We may reject any file without giving reasons.

We may review, hide, edit metadata of, or remove any upload at any time — for example after a report, a copyright notice, an automated signal, or if we believe it breaches this Agreement. Our process for notices and counter-notices is described in the Copyright & DMCA Policy. Repeated violations lead to account termination. We have no obligation to host any particular sound and no liability for removing it.

You are solely responsible for your uploads. To the fullest extent permitted by law, you will defend, indemnify and hold harmless Kryptonite, VibeDojo, Cardinal and their members, collaborators and service providers from and against any claim, demand, damage, loss, fine, cost or expense (including reasonable legal fees) arising from or related to: (a) any sound or metadata you upload; (b) any breach of the warranties in this Agreement; or (c) any infringement of third-party rights by your upload, including claims brought by users or AI-agent operators who used your sound under the licence you declared.

We will notify you of any such claim, and may choose to control the defence ourselves, in which case you will cooperate reasonably. This section survives the removal of the sound and the closure of your account. Nothing in it limits rights you have as a consumer that cannot be waived by contract.

For each upload we store a record of your acceptance: your user ID, the statements accepted, the agreement version, the date and time, a salted hash of your IP address and your browser's user agent. We keep it as evidence for as long as the sound is online and for up to 10 years after removal, as described in the Privacy Policy.

We may update this Agreement. New versions apply only to uploads made after you accept them; the version you accepted continues to govern your earlier uploads. This Agreement is governed by Italian law, as set out in the Terms of Service. Questions: hello@kryptonite.gg.
