Terms of Service

These Terms govern your use of Kryptonite — the website, the sound catalog, the MCP server, the REST API and the Studio. Please read them; by using the Service you agree to them.

01Who we are and this agreement#

Kryptonite (the “Service”) is a project by VibeDojo, operated together with Cardinal (together, “Kryptonite”, “we”, “us”). You can reach us at hello@kryptonite.gg.

These Terms of Service (the “Terms”) form a binding agreement between you and us. They incorporate the Acceptable Use Policy, the Copyright & DMCA Policy and, if you publish sounds, the Upload Agreement. Our Privacy Policy and Cookie Policy explain how we handle personal data.

You may use the Service only if you can form a binding contract. If you are under the age of digital consent in your country (14 in Italy, up to 16 elsewhere in the EU) you may use the Service only with the involvement of a parent or guardian, who accepts these Terms on your behalf. If you use the Service on behalf of an organisation, you confirm you are authorised to bind it, and “you” includes that organisation.

02The Service#

Kryptonite is a searchable directory of meme sounds, sound effects and reaction sounds. It includes:

  • the website, where you can browse, preview and download sounds;
  • a remote MCP server (/api/mcp/mcp) and a REST API (/api/v1) that let AI agents and software search, inspect and download the same catalog;
  • the Studio, an in-site AI assistant that suggests sounds for a scene you describe;
  • community uploads, which let signed-in users publish their own sounds.

The catalog combines sounds released under open licences (for example CC0), sounds uploaded by users, and community-sourced sounds whose rights have not been verified. We may add, change or remove features, sounds and limits at any time. The Service is currently free; if we ever introduce paid features, they will be governed by separate terms presented to you before purchase.

03Accounts#

Some features (higher quotas, API keys, uploads) require an account. You can sign up with an email and password or, where available, with a third-party login such as GitHub or Google.

  • Give accurate information and keep it up to date. One person per account; accounts are not transferable.
  • Keep your password and sessions secure. You are responsible for all activity under your account.
  • Tell us promptly at hello@kryptonite.gg if you suspect unauthorised access.
  • Don't create accounts in bulk or by automated means, and don't create a new account to evade a suspension.

You can stop using the Service and ask us to delete your account at any time.

04API keys, MCP access and quotas#

Access through the MCP server and the REST API is subject to daily quotas, which reset at 00:00 UTC:

Daily quotas
AccessSearches / dayDownloads / dayHow it is counted
Anonymous55Per network address (stored only as a salted one-way hash)
Free account (session or API key)1,000300Per user account, across all your keys

API keys (format kr_live_…) are created in your dashboard. They are personal credentials: keep them secret, don't embed them in public code or client-side apps, and revoke any key you think has leaked. We store only a hash of each key and cannot show it to you again.

Fair use. The quotas are an upper bound, not a guarantee. You must not:

  • circumvent or attempt to circumvent quotas or rate limits, e.g. by rotating IP addresses, using multiple accounts or sharing keys;
  • scrape, crawl, bulk-download or systematically mirror the catalog, its audio files or metadata, or use them to build a competing directory, dataset or clone of the Service;
  • use the catalog or audio to train or fine-tune machine-learning models without our prior written consent;
  • place excessive load on the infrastructure, probe it for vulnerabilities, or interfere with other users.

Temporary caching of search results and metadata within a single editing session is fine. We may change quotas, throttle traffic, or suspend keys and accounts that abuse the Service.

05AI agents acting on your behalf#

Kryptonite is built to be used by AI agents (for example Claude, Cursor or a video-editing agent) through MCP or the REST API. When an agent accesses the Service with your session, your API key or from your network, it acts on your behalf:

  • you are responsible for every request the agent makes and for how it uses the sounds it downloads;
  • you must make sure the agent respects these Terms, the quotas and the licence of each sound (every response includes it);
  • you must review the agent's choices before publishing content — in particular, never use a sound marked “Rights unverified” in monetised or commercial work.

Suggestions produced by the Studio or by any AI model are generated automatically and may be inaccurate, inappropriate or wrong about a sound's licence. Always check the sound page, which is the authoritative source for its licence label.

06Sound licences#

We do not own the sounds in the catalog and these Terms do not grant you any right in them. Any right to use a sound comes from its licence, as shown on the sound page and in every API/MCP response:

Licence labels
LabelWhat you may doCommercial use
CC0 1.0Public domain dedication. Free to reuse, including commercially, no attribution required.Yes
CC BY 4.0Free to reuse, including commercially, with attribution to the author. Use the attribution text provided.Yes, with credit
Uploader's own workUploaded by the author, who declares to own all rights. Personal use; contact the author for commercial use.Ask the author
Rights unverifiedCommunity-sourced sound. Rights belong to their respective owners and have not been verified. Personal, non-commercial use only. Verify the licence before any commercial or monetised use.No

Licence labels are informational. They are based on the source of the sound or on the uploader's declaration, and we cannot verify them for every file. Many community-sourced meme sounds originate from films, TV, games, apps or social media; their rights belong to the original owners. Before any commercial, advertising or monetised use, you must verify the licence yourself and, where needed, obtain permission from the rights holder.

“Rights unverified” sounds are made available for personal, non-commercial use only — for example a private video, a meme shared with friends or a non-monetised edit — and only to the extent permitted by the law applicable to you (such as quotation, parody or pastiche exceptions). If you own one of these sounds and want it removed, see our DMCA Policy.

07Your content#

“User Content” means sounds, titles, descriptions, tags, attributions, reports and any other material you submit. You keep ownership of your User Content.

  • Every upload is governed by the Upload Agreement, which you accept with each upload. In short: you must own or be licensed to publish the sound, it must not contain third-party copyrighted material, and you grant us the licence needed to host and distribute it to users and AI agents.
  • You are solely responsible for your User Content and for the consequences of publishing it, including any claim that it infringes someone else's rights.
  • Files are re-encoded and scanned before publication. We may refuse, hide or remove any User Content at our discretion, including after a report or a notice. We have no general obligation to monitor User Content, but we act on notices as described in our DMCA Policy.

08Acceptable use#

You must follow the Acceptable Use Policy. It forbids, among other things, infringing content, malware, unlawful or hateful material, recordings of people without consent, voice impersonation and abuse of the infrastructure.

10Our intellectual property#

The Service — its software, design, the Kryptonite name and crystal logo, the selection and arrangement of the catalog, the metadata we create (categories, tags, descriptions, waveforms) and the documentation — belongs to us or our licensors and is protected by intellectual-property laws, including the sui generis database right.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. This licence does not cover the sounds themselves (see section 6) and does not allow you to copy, resell, sublicense or reverse-engineer the Service, except where the law expressly allows it.

If you send us feedback or suggestions, we may use them freely without any obligation to you.

11Third-party services#

The Service links to and relies on third parties — for example login providers, the AI models behind the Studio, and the original sources of some sounds. We are not responsible for third-party websites, services or content, and your use of them is governed by their own terms.

12Disclaimers#

To the maximum extent permitted by law, the Service, the catalog and all sounds are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

In particular, we do not warrant that any sound is free of third-party rights or suitable for commercial use, that licence labels or metadata are accurate, that AI-generated suggestions are correct, or that the Service will be uninterrupted, secure or error-free.

Nothing in these Terms excludes warranties or rights that cannot be excluded under the law applicable to you as a consumer.

13Limitation of liability#

To the maximum extent permitted by law:

  • we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunities, including losses arising from takedowns, demonetisation or claims against content you published with sounds from the Service;
  • our total liability for all claims relating to the Service is limited to the greater of €50 or the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

These limitations do not apply to liability for wilful misconduct or gross negligence (art. 1229 of the Italian Civil Code), for death or personal injury, or to any other liability that cannot be limited under applicable law, including mandatory consumer-protection rules.

14Indemnity#

To the extent permitted by law, you agree to defend, indemnify and hold harmless Kryptonite, VibeDojo, Cardinal and their members, collaborators and service providers from any claim, damage, loss, cost or expense (including reasonable legal fees) brought by a third party and arising from: (a) your User Content; (b) your use of the Service or of any sound obtained through it, including use by AI agents acting on your behalf; or (c) your breach of these Terms or of any third-party right.

15Suspension and termination#

You may stop using the Service at any time. We may suspend or terminate your access, revoke API keys or remove content, with or without notice, if you breach these Terms, if required by law or a public authority, to protect the Service or other users, or if we discontinue the Service. Where reasonable we will tell you why and give you a chance to respond, in line with the EU Digital Services Act.

Sections 6, 7 (licence granted to us for content already distributed), 10 and 12–18 survive termination.

16Changes#

We may update these Terms from time to time. We will post the new version here and update the “Last updated” date. For material changes we will give reasonable advance notice (for example on the site or by email) of at least 15 days, unless the change is required by law or addresses abuse. If you keep using the Service after the changes take effect, you accept the new Terms; if you don't agree, stop using the Service and delete your account.

17Governing law and disputes#

These Terms are governed by the laws of Italy, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your place of residence as provided by law (including art. 66-bis of the Italian Consumer Code). Otherwise, the courts of the operator's registered seat in Italy have exclusive jurisdiction.

Before going to court, please contact us at hello@kryptonite.gg — most issues can be solved quickly and informally.

18General#

  • These Terms, together with the policies they reference, are the entire agreement between you and us about the Service.
  • If any provision is held invalid, the rest remains in force and the invalid provision is replaced by a valid one with the closest effect.
  • Our failure to enforce a provision is not a waiver of our right to do so later.
  • You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or transfer of the Service.
  • These Terms are written in English. Any translation is for convenience only; the English version prevails to the extent permitted by law.
