Copyright & DMCA Policy
01Our approach#
We respond to notices of alleged infringement under the US Digital Millennium Copyright Act (17 U.S.C. §512), the EU Digital Services Act (Regulation (EU) 2022/2065, art. 16) and Italian copyright law (Law no. 633/1941). Many sounds in the catalog are community-sourced and labelled “Rights unverified” — they remain the property of their owners, and owners can ask us to remove them at any time, no questions asked.
02Fastest route: the Report button#
Every sound page has a Report button (/sounds/<id>/report). Choose “Copyright / DMCA”, describe your work and leave a contact email. Sounds that receive several reports may be hidden automatically while a person reviews them. You don't need an account to report.
03Formal takedown notice#
To send a formal notice, email hello@kryptonite.gg with:
- your physical or electronic signature, as the rights holder or a person authorised to act on their behalf;
- identification of the copyrighted work (or works) you claim is infringed;
- identification of the material on Kryptonite — the sound page URL (e.g.
https://kryptonite.gg/sounds/<id>) or sound ID — with enough information for us to locate it; - your name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent or the law;
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the rights holder or authorised to act on their behalf.
04What happens next#
- We confirm receipt and review the notice.
- If it is valid, we remove or disable access to the sound — including from the MCP server and REST API — expeditiously, normally within 72 hours.
- If the sound was uploaded by a user, we notify them with a statement of reasons (as required by the DSA) and the option to file a counter-notice.
- We let you know the outcome. Decisions can be contested through our internal process by replying to our email.
Files already downloaded by users or agents before removal are outside our control; the licence label shown at the time remains their only basis for use.
05Counter-notice#
If you uploaded a sound that was removed and you believe this was a mistake or misidentification, email hello@kryptonite.gg with:
- your physical or electronic signature;
- identification of the removed sound and where it appeared before removal;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the competent courts (for US users, the federal district court for your address; otherwise the courts of Italy) and will accept service of process from the person who filed the original notice.
We forward valid counter-notices to the original complainant. Unless they tell us within 10–14 business days that they have started legal proceedings, we may restore the sound.
06Repeat infringers#
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe. As a rule, an account that receives three valid notices (“strikes”) within twelve months is closed, and blatant infringement can lead to immediate termination. Strikes expire after twelve months; a successful counter-notice removes the strike.
07False or abusive notices#
Knowingly misrepresenting that material is infringing — or that it was removed by mistake — may make you liable for damages (17 U.S.C. §512(f)). Under the DSA we may suspend the processing of notices from people who frequently submit manifestly unfounded ones.
08Designated contact#
Copyright agent: VibeDojo — operated with Cardinal — email hello@kryptonite.gg. This is also our point of contact for authorities and users under the Digital Services Act (arts. 11–12); we accept communications in English and Italian. For other abuse (malware, offensive content) use the Report button or see the Acceptable Use Policy.
